Belarus tightens terms of access to public procurement for some foreign commodities – draft resolution

Belarus tightens the terms of access to public procurement for some foreign commodities thus granting advantages with respect to goods originating from the Eurasian Economic Union (EEC: Armenia, Belarus, Kazakhstan, Kyrgyzstan, Russia), as per Council of Ministers’ draft resolution on amendments to Council of Ministers’ resolution No.206 of March 17, 2016 and No.395 of June 15, 2019, Arzinger & Partners law firm says in a comment. </p> <p> </p> <p> According to the draft, the list of goods of foreign origin, which are admitted to the public procurement, is expanded, provided that there are less than two supply proposals from the territory of the EEU. The list includes goods used in the electrical and electronic industry, as well as clothing, medical equipment, etc. </p> <p> </p> <p> The list of origin confirmation documents is also expanded, among other things, for the application of a margin of preference under the procurement procedure. </p> <p> </p> <p> Goods originating from Belarus may be supplied with in-house production certificates issued by the Belarusian Chamber of Commerce and Industry. Procurers who are not producers need to confirm their eligibility, e.g. by contract or power of attorney. </p> <p> </p> <p> Goods originating from the countries that are granted national treatment in Belarus will need certificates of origin issued in these countries or by the Belarusian Chamber of Commerce and Industry for non-resident and resident procurers, respectively. </p> <p> </p> <p> Also, the draft allows purchasing goods from a single source, if the prices are regulated by the state. Such goods can be procured directly from manufacturers, except for those included in the State Register of Economic Entities that dominate the Belarusian commodity markets. End </p>
