Belarus revises public procurement procedure – draft resolution
<p> MINSK, Jan 20 - PrimePress. Belarus will amend the public procurement procedure as proposed by a draft resolution of the Ministry of Antimonopoly Regulation and Trade (MART) of Belarus put up for public discussion at the Legal Forum on January 20-30, 2021. </p> <p> </p> <p> According to the draft resolution, the Council of Ministers will be vested the authority to approve lists of goods, works and services, to which the preferential change applies, as well as the procedure and terms for its application. The government will have the right to state bodies and organizations that will establish standard requirements for the description of the kinds of goods, works and services for the mandatory inclusion in the public procurement catalog upon coordination with MART. </p> <p> </p> <p> Also, the government will define specifics of public procurement of certain goods, conditions for admission of goods, works and services of foreign origin and their suppliers, which will be admitted in exceptional circumstances in order to protect the domestic market and support domestic producers in compliance with international commitments. Such exceptions are possible for a period of two years. They will be specified by the government of the Republic of Belarus, MART says in an explanatory note. </p> <p> </p> <p> The draft resolution entitles MART to set additional requirements to the form and content of public procurement bids, the procedure and methods for determining the approximate value of public procurement items to avoid inefficient spending of budgetary funds. </p> <p> </p> <p> According to the draft resolution, resident public procurement parties will no longer be required to confirm the absence of tax, fee (duty) or penalty liabilities, which will be thereafter confirmed by the customer (organizer) on the official website of the Ministry of Taxes and Duties. </p> <p> </p> <p> It is also proposed to introduce a ban on the participation in the procurement of affiliated entities in relation to other bidders. The exception would be made for legal entities owned by the Republic of Belarus or its administrative and territorial units, public associations of disabled people, and legal entities that are members of a state association or a holding.
