Belarus eases requirements to trade and public catering – law
<p> MINSK, Jan 12 - PrimePress. Belarus has eased the requirements for doing business in trade and public catering, as per law No.81-З of January 4, 2021 posted on the National Legal Internet Portal. </p> <p> </p> <p> The House of Representatives of the National Assembly passed the bill on December 16, 2020. The Council of the Republic passed it on December 18, 2020. </p> <p> </p> <p> Public catering entities no longer must maintain the previously required range of catering products, and do not have to provide retail and/or wholesale trade turnover reports for the Commercial Register of the Republic of Belarus. </p> <p> </p> <p> Business entities can independently schedule business hours of retail outlets, public catering facilities, shopping centers and markets (except for form 11pm to 7am) subject to approval by city and district executive committees and local administrations of Minsk city districts. </p> <p> </p> <p> Retail outlets, public catering facilities, shopping centers and markets may open upon notification filed with the Commercial Register of the Republic of Belarus within five days after the opening. </p> <p> </p> <p> Land users may use land plots for intended purpose and accommodate relocatable and mobile retail facilities without changing the intended purpose of the land plots. </p> <p> </p> <p> Entities engaged in retail trade in foods through distribution networks or large stores can independently calculate their share in retail food turnover in the previous fiscal year in Minsk, regionally governed cities and districts. </p> <p> </p> <p> Entities engaged in retail trade in foods through distribution networks or large stores and entities engaged in public catering through catering networks, whose annual turnover is 80,000 base values (Br2.32 million or $899,700 at the rate of National Bank of Belarus; 1 base value equals Br29 or $11.25) or over, must provide suppliers with information about the contract partner selection terms and other information required for entering into food supply contracts by posting the information on their websites. </p> <p> </p> <p> Food supply contract prices will be determined based on the price of foods under supply contracts, unless pricing legislation establishes otherwise. </p> <p> </p> <p> Food suppliers are not required to indemnify losses resulted damages to the foods they supply after their transfer into ownership of the traders and caterers, unless the damages are caused by the suppliers. </p> <p> </p> <p> Traders and caterers may not demand the return to the food suppliers of unsold products, the shelf life of which has expired, or the return of foods not sold within the established period. </p> <p> </p> <p> The law enters into force six months after its official publication. </p>
