Belarus decriminalizes some minor crimes

Belarus has decriminalized some crimes that do not constitute a great danger to society punishable if committed within a year after the imposition of an administrative penalty for the same offense. This is established by law No.85-3 on amendments to the Criminal Code and the Criminal Procedure Code issued on January 6, 2021 and posted on the National Legal Internet Portal. </p> <p> </p> <p> Amendments to the Criminal Code decriminalize illegal disposition of funds in bank accounts of a business entity; consumer fraud; violation of the rules of protection of mineral resources; violation of radiation control rules; illegal use of the emblems of the Red Cross, Red Crescent and Red Crystal; illegal occupation of land (squatting); handing of items or substances to a person held in a detention facility or penitentiary, or serving a custodial sentence, etc., or acceptance of items or substances from such person; insult; deliberate disclosure of data from an inquiry, preliminary investigation or closed court hearing committed by a person who has access to materials of a criminal case in the line of duty. </p> <p> </p> <p> Amendments to the Criminal Procedure Code concern the legal regulation of activities of bodies in charge of criminal proceedings and rights and obligations of parties to the criminal process. The Code is supplemented with an article on the prohibition of certain actions as a preventive measure as a pre-trial restriction, and the right to appeal in court against the termination of criminal proceedings in light of newly discovered evidence.
