Belarus creating more efficient scheme of interaction between holding participants - EconMin
<p> MINSK, Oct 8 – PrimePress. A more efficient scheme of cooperation between participants of holdings is under development in Belarus. This is stated in the comments of the Belarusian Ministry of Economy to presidential ordinance #385 “On establishment and operation of holding companies” of 7 October 2021. </p> <p> </p> <p> “The document was prepared by the Ministry of Economy proactively on the basis of the monitoring and analysis of the law enforcement practice. The purpose of ordinance #385 is to improve the economic, organizational and managerial conditions for the functioning of holdings, aimed at improving the efficiency of the activities of the participants in these associations,” reads the commentary. </p> <p> </p> <p> The ordinance includes general provisions for regulating the activities of holding companies, as well as special features for holding companies with state participation. </p> <p> </p> <p> Ordinance #385 abolishes redundant regulations (namely, the requirement to develop an organizational and economic rationale for the creation of holding companies with state participation, as well as for the development strategy of such holding companies); it also introduces a ban on the entry of a state holding company as its management company - as a mutually exclusive form of integration; it grants a holding participant the right to represent other participants in courts in cases of such holding participants, to provide legal and protection services to participants of a single holding. </p> <p> </p> <p> In addition, in accordance with the ordinance, holding company participants are excluded from a number of legislative norms - in the area of managing state property, legislation on combating corruption, etc., the Economy Ministry said.
