Belarus plans to ban state concerns from entering holding groups as managing company

Belarus plans to prohibit the state concerns from entering holding groups as a managing company, in accordance with the draft presidential ordinance “On the establishment and operation of holding companies”. </p> <p> </p> <p> The draft has been posted on the legal forum of Belarus for public discussion. </p> <p> </p> <p> “Initially, the very concept of creating holding structures did not provide for such a possibility, since a holding group and a state concern are two mutually exclusive forms of integration by their legal and economic nature… However, Ordinance </p> <p> #660 of December 28, 2009, which regulates the operation of holding groups in the country, does not contain an explicit prohibition on mixing these types of associations, which resulted in creation of holding companies headed by state concerns. In this connection, in order to prevent further establishment of such associations, the ordinance prohibits them.” End </p> <p> </p>
