Belarus govt changes public procurement procedure
<p> MINSK, Jul 23 - PrimePress. The Government of Belarus has changed the procedure for companies to purchase goods and services at their own expense. The main innovations of the document are the obligation to study the market conditions in carrying out single-source procurement procedures and a list of goods, the procurement of which should ensure a minimum share of Belarusian goods. </p> <p> </p> <p> The new terms of public procurement are specified in the Council of Minister’s resolution </p> <p> #415 of July 20, 2021, which was published on the National Legal Internet Portal. </p> <p> </p> <p> The government regulates the procurement of goods and services made by at their own expense by state-owned enterprises and enterprises with the state share over 25%. </p> <p> </p> <p> The document says when studying the market situation, the buyer is obliged to send requests to domestic producers, including organizations that are part of the same holding company or state association as the buyer. </p> <p> </p> <p> Domestic producers are defined as legal entities of the Republic of Belarus that produce goods, perform works or render services, and natural persons - citizens of the Republic of Belarus, foreign citizens and stateless persons, including those who are individual entrepreneurs permanently residing in Belarus. </p> <p> </p> <p> The resolution also endorses an extensive list of goods, the procurement of which must ensure a minimum share of Belarusian goods. For instance, within one year, the share of Belarusian goods in the total volume of goods procured by an enterprise shall be not less than 70% for body parts and accessories, including cabins, electric stoves, optical communication cables, electric motors, 75% for margarine, not less than 90% for electric lighting equipment, recessed electric household cookers, lifts, forklifts - bale loaders, buses and trucks, etc. </p> <p> </p> <p> Among other innovations approved by the resolution is the elimination of the obligation to apply the preferential adjustment factor to the prices of domestically produced goods. </p> <p> </p> The single-source procurement procedure can be applied in the event of purchasing goods from the manufacturer, as well as when there is an urgent need for procurement, and in some other cases.
